Firearms and Involuntary Civil Commitment
18 U.S. Code § 922(g)(4) makes it a crime for any person who has been adjudicated as a mental defective or who has been committed to a mental institution to … possess … any firearm or ammunition.
Most people are not aware that, if they were to engage in any type of self-harm or suicidal behavior, they WILL PROBABLY be involuntarily committed to a mental health facility once they're taken to a hospital.
If they're Second Amendment advocates, and as a result, have firearms or wants to buy firearms sometime in the future, one of the serious and permanent consequences of this involuntary civil commitment is that, from then on, U.S. Federal Law [18 USC § 922(g)(4)] makes it a serious crime for them to possess a firearm or even a single bullet/shotshell.
This website will contain documents that pertain to my Civil Rights and Medical Malpractice lawsuit against the named defendants. I’ve filed this lawsuit against them in order to recover my Second Amendment rights (i.e., overcome my unlawfully and unjustly imposed Firearm Disability) that were lost as a result of my 5-day unlawful, Involuntary Civil Commitment in the psychiatric unit/ward (i.e., “Unit 3-6”) at St. Joseph’s Hospital Health Center (henceforth, “St. Joseph’s” or “SJHHC”) between April 12, 2013 and April 17, 2013.
As a result of my unlawful, involuntary civil commitment under New York State Mental Hygiene Law Section 9.27, I’m barred by Federal Statute 18 U.S.C. § 922(g)(4) from ever possessing any type of firearm or even a single bullet/shotshell. In addition, an involuntary civil commitment record can have significant detrimental impact on my future, potential employment opportunities.
Thus, this lawsuit is my attempt under my First Amendment rights and analogous State rights, to regain my Second Amendment rights that were lost, as a result of SJHHC’s and the other defendants’ intentional and/or negligent actions and/or omissions during the period of April 05, 2013 to April 17, 2013, as well as after that period.
